Med Cards Now operates solely as a platform for medical evaluations and does not engage in the cultivation, manufacture, distribution, or sale of cannabis or related products. Licensed Health Care Providers using the platform do not supply or assist in obtaining cannabis in any form, including purchase, delivery, or production.

Cannabis is classified as a Schedule I controlled substance under the federal Controlled Substances Act, making its possession, use, cultivation, and distribution illegal under federal law. By accepting this Agreement, you acknowledge the legal risks associated with medical cannabis use, including potential federal enforcement. You agree that Med Cards Now and its Licensed Health Care Providers are not responsible for any legal consequences, claims, or damages arising from your use or possession of cannabis. You are solely responsible for understanding and complying with the laws in your state.

Access to the platform is limited to individuals who can verify residency in a state (including the District of Columbia) where medical cannabis is legally permitted. Residency must be confirmed באמצעות a valid, government-issued, non-expired identification. Once verified, Med Cards Now connects you with a Licensed Health Care Provider authorized to practice in your state.

You acknowledge the conflict between federal and state cannabis laws and understand that providers are not obligated to recommend cannabis. Any recommendation is based solely on the provider’s independent medical judgment following a proper evaluation in accordance with state regulations. To complete your application, you may be required to submit personal information such as your name, date of birth, identification, and contact details. In some states, additional information may be required.

By consenting to telemedicine services, you authorize the use of your personal and medical information through secure channels for evaluation and processing. Med Cards Now and its Licensed Health Care Providers do not guarantee treatment outcomes. If approved, you are responsible for obtaining cannabis in compliance with applicable state laws, and all qualifying conditions and treatments are governed by state-specific regulations.

Consent to Communications & Notifications

By continuing to use this website and opting into certain services, you agree to receive automated marketing messages and/or phone calls from representatives of Med Cards Now. Providing consent is not a condition of any purchase. Standard message and data rates may apply.

You may opt out of electronic communications at any time by using the unsubscribe option provided in our messages.

At no time should you offer cash or any form of payment to Med Cards Now or to any Licensed Health Care Provider in exchange for a Patient Recommendation. While consultation fees apply for medical evaluations, a recommendation is not guaranteed. All Patient Recommendations are based solely on the independent medical judgment and professional discretion of the Licensed Health Care Provider.

This website is intended for individuals who are at least eighteen (18) years old. If you are under 18, a parent or legal guardian must supervise your use of the site. Licensed Health Care Providers will not issue Patient Recommendations to minors unless it is permitted under applicable state laws and regulations, which may require parental or legal guardian consent.

Where required, consent forms will be provided to the parent or legal guardian for completion prior to any evaluation or Patient Recommendation. Med Cards Now does not knowingly collect personal information from individuals under the age of 18 through this website.

Your Relationship with Med Cards Now Platform

Med Cards Now provides a platform that enables you to connect with a Licensed Health Care Provider and access educational information related to the medical use of cannabis. You may choose to use this information as part of your healthcare and wellness decisions. The services offered through this website do not replace in-person medical care.

All decisions regarding diagnosis and treatment recommendations are made solely between you and your selected Licensed Health Care Provider. By using this platform, you acknowledge that you are not establishing a doctor-patient relationship with Med Cards Now. You further understand that Med Cards Now is not a Licensed Health Care Provider and does not supply cannabis for medical use.

By agreeing to these Terms of Use, you acknowledge that your Licensed Health Care Provider may communicate with you through the platform, including messages, reports, and emails related to your care. You are responsible for reviewing all such communications in a timely manner.

You agree that Med Cards Now is not responsible for any loss, injury, or claims resulting from your failure to review these communications or to follow the medical guidance provided by your Licensed Health Care Provider.

Platform Structure & Compliance Overview

Med Cards Now operates as a platform that provides the website, supporting technology, and administrative services to enable Licensed Health Care Providers and their qualifying patients to connect and communicate, as outlined in these Terms of Use and throughout the Site.

Medical Cannabis States have different laws and regulations governing a Licensed Health Care Provider’s ability to recommend cannabis for medical use to individuals under the age of 18 (“minors”). If you are a minor, your parent or legal guardian is responsible for understanding and complying with all applicable state laws and requirements related to Patient Recommendations for minors in your state of residence.

Service Eligibility & State-Based Access

Med Cards Now services are available only to qualifying patients who reside in states where medical cannabis is legally permitted (“Medical Cannabis States”). The scope of services provided through the platform may vary based on the patient’s qualifying debilitating condition and/or medical treatment (such as chemotherapy or radiotherapy), as defined by applicable state laws and regulations.

Service availability also depends on the patient’s state of residence and the licensure of the Licensed Health Care Provider. The platform is designed to provide qualifying patients with relevant information to help them select appropriate Licensed Health Care Providers, access permitted telehealth services (where allowed by state law), and coordinate their care effectively.

All services offered by Med Cards Now are subject to applicable state laws and regulations and may be updated or modified as those legal requirements evolve.

Telehealth Consultation & Medical Evaluation Limitations

Where permitted by applicable Medical Cannabis State laws, your Licensed Health Care Provider may use the Med Cards Now platform to provide medical advice or a diagnosis. However, services delivered through the platform do not include an in-person physical examination. As a result, your provider may not have access to certain clinical observations or information that would typically be obtained during an in-person visit, which may impact their medical assessment.

By choosing to use this platform, you acknowledge and accept these limitations. You understand and agree that:

(i) any diagnosis provided is limited and preliminary;
(ii) it is not a substitute for a comprehensive in-person medical evaluation;
(iii) your provider may lack information normally obtained through physical examination; and
(iv) the absence of such examination may affect the accuracy or completeness of the diagnosis.

In some Medical Cannabis States, an in-person medical examination may be required before a Licensed Health Care Provider can issue a Patient Recommendation. If such requirements apply, Med Cards Now will assist in coordinating an in-office visit. If you choose not to complete the required examination(s), the provider will not be able to issue a recommendation on your behalf.

You further acknowledge that any medical opinion provided by a Licensed Health Care Provider through this platform is solely that of the provider and not Med Cards Now. Such opinions may not be used in any legal claims or proceedings against Med Cards Now, including but not limited to litigation, arbitration, disability claims, workers’ compensation claims, or malpractice actions.

To ensure compliance with applicable laws, services are offered only in states where medical cannabis use is permitted. Currently, Med Cards Now provides services in the following states: California, Connecticut, Illinois, Maryland, Massachusetts, Michigan, Minnesota, Missouri, New Jersey, New York, Nevada, Ohio, Oklahoma, Pennsylvania, and West Virginia.

Limitation of Liability

To the maximum extent permitted by applicable law, Med Cards Now shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or related to your use of, or inability to use, the platform or services. This includes, without limitation, damages for loss of data, loss of profits, business interruption, or any adverse medical outcomes, whether based in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages.

In no event shall the total aggregate liability of Med Cards Now, its affiliates, or its Licensed Health Care Providers exceed the lesser of (a) the total amount paid by you for the services giving rise to the claim, or (b) five hundred dollars (USD $500), whichever is less.

Privacy & Regulatory Disclosure Notice

Med Cards Now recognizes the importance of protecting the confidentiality and privacy of your health information. Please refer to our Privacy Policy for details on how your personal data is collected, used, and safeguarded.

By accepting this Agreement, you acknowledge and agree that certain healthcare records related to any Patient Recommendation issued by your Licensed Health Care Provider may be subject to required disclosure to appropriate government authorities, in accordance with the laws and regulations of your Medical Cannabis State.

This may include medical records confirming that you have been diagnosed with a qualifying condition or are undergoing treatments for which medical cannabis may be considered appropriate. Such disclosures, when required, may be made by Med Cards Now or your Licensed Health Care Provider in compliance with applicable state laws and regulations.

User Responsibilities for Accurate Information & Telehealth Access

If you choose to consult with a Licensed Health Care Provider through Med Cards Now, you are responsible for ensuring proper real-time audio and video access that meets the platform’s technical and quality requirements. This is necessary to support an effective evaluation and communication with your provider.

You are also required to provide complete, truthful, and accurate information in all patient forms and any additional requests submitted through the platform by your Licensed Health Care Provider.

Provider Independence & No Endorsement Policy

Licensed Health Care Providers who use or are listed on the Med Cards Now platform operate as independent professionals and are not employees, agents, or contractors of Med Cards Now. Any opinions, advice, or medical information shared by these providers or affiliated facilities are solely their own and do not reflect the views or positions of Med Cards Now.

Med Cards Now does not recommend, endorse, or guarantee any specific providers, medical treatments, tests, products, medications, procedures, or the use of cannabis for medical purposes. The inclusion of any Licensed Health Care Provider on the platform or within a directory is for informational purposes only and should not be interpreted as validation of their credentials, qualifications, or expertise.

All information provided through the platform is offered on an “as-is” basis without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose. Med Cards Now is not responsible for any decisions or actions taken based on such information. The platform may not be used to verify or confirm the credentials of any Licensed Health Care Provider.

Account Registration, Security & Payment Terms

Registration is not required to browse the Med Cards Now website; however, certain services are accessible only to registered users with secure login credentials (“Secure Users”). If you create an account, you agree to provide accurate, current information and keep it updated. Failure to do so, or any suspected misuse, may result in suspension or termination of your account. You are responsible for maintaining the confidentiality of your login credentials and may not share or use another individual’s account. Requests for Patient Recommendations must be made only for yourself, except where a parent or legal guardian is authorized to act on behalf of a minor in accordance with applicable state laws.

You are required to promptly report any unauthorized access, security breach, or misuse of your account and ensure you log out after each session. Med Cards Now is not liable for any losses or damages resulting from your failure to safeguard your account. The platform uses secure login identifiers and encryption technologies, such as SSL, to protect sensitive and personally identifiable information. While reasonable safeguards are in place, the platform operates on systems that may occasionally require maintenance or experience technical or security-related issues beyond control.

You agree to use the website responsibly and not attempt to compromise its security. Any unauthorized access, misuse, or attempted violation may result in account termination, legal action, and cooperation with law enforcement authorities where applicable.

For paid services, Med Cards Now facilitates payments to Licensed Health Care Providers and may offer additional non-cannabis-related services or products. Payments must be made using accepted major credit cards; cash is not accepted. By submitting payment, you authorize Med Cards Now to charge your card for applicable fees. If a transaction cannot be completed due to an invalid or expired card, you must promptly provide updated payment information. Services will not be delivered until full payment has been successfully received and verified.

Payment Terms, Service Delivery & Refund Policy

Payment is required at the time of booking and covers the medical consultation, along with the digital delivery of your recommendation document and/or approval letter via email. In California only, if selected, a hard copy and photo ID card may be mailed to the address provided (standard delivery without tracking; expedited options may be available at an additional cost). For all other states, only digital documents are provided. Optional add-on services may be available for an additional fee. Payments are accepted via major credit and debit cards.

All services provided by Med Cards Now are medical consultation services and are considered complete once delivered. The physician’s medical marijuana recommendation or approval letter is a digital product, and successful delivery to the email address provided confirms fulfillment of the service.

To request a cancellation, you must submit a written request from the same email address used during the application. Cancellations are only permitted before the consultation is completed. Once a Licensed Health Care Provider has conducted the consultation and issued a recommendation or approval, cancellations and refunds are no longer available.

If a valid cancellation request is received before services are rendered, a refund will be processed and typically returned to your original payment method within 5–7 business days. Refunds are not issued for completed services, including cases where the recommendation has been approved and delivered. However, a full refund may be considered if you were not evaluated, not approved, or did not receive your digital document within the applicable timeframe (California only). All refund decisions are made at the sole discretion of Med Cards Now, and the final determination of eligibility for a medical marijuana recommendation rests exclusively with the Licensed Health Care Provider.

Website Use Rights & Intellectual Property Protection

All content on the Med Cards Now website, including text, graphics, images, logos, design elements, and other materials (“Content”) is owned by Med Cards Now or its respective content providers and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive license to access and use the site for personal purposes only. This license does not permit downloading (except for standard page caching), modifying, reproducing, or creating derivative works without prior written consent.

You may not copy, distribute, sell, resell, or exploit any portion of the website or its content for commercial purposes without explicit authorization. The use of data mining tools, automated extraction methods, framing techniques, meta-tags, or hidden text that utilize Med Cards Now’s trademarks or proprietary information is strictly prohibited without written approval.

All rights, title, and interest in the website and its content—including all intellectual property rights—remain with Med Cards Now or the respective third-party owners. Any use of the platform beyond the permissions granted in this Agreement will result in immediate termination of your access rights and may lead to further legal action.

Content Ownership & Intellectual Property Protection

All content available on the Med Cards Now website—including text, images, graphics, audio, video, and overall site design—is protected by U.S. and international copyright laws and is owned by Med Cards Now or its third-party content providers. The organization, selection, and presentation of this content are also the exclusive property of Med Cards Now. Except where explicitly permitted, you may not copy, modify, reproduce, distribute, publish, transmit, or create derivative works from any content without prior written authorization.

Unauthorized use of any content, including images or text, may violate copyright, trademark, privacy, and other applicable laws. Med Cards Now does not guarantee that your use of site materials will not infringe on third-party rights. If your intended use extends beyond personal purposes, you may need to obtain proper licensing from the respective rights holders. You agree to indemnify and hold Med Cards Now harmless from any claims or damages resulting from misuse of content or violation of these terms.

All trademarks, logos, service marks, and design elements displayed on the site—including the Med Cards Now name and branding—are the property of Med Cards Now or their respective owners. You agree not to use, reproduce, or display any such intellectual property without prior written consent.

Approval Delivery & Missing Documentation Process

If you have been approved for services but have not received your approval email or documentation, you must notify Med Cards Now within 7 calendar days of your approval date by sending an email to Contact@medcardsnow.com. While phone support (+1-626-323-2358) is available for assistance, email is the only accepted method for creating an official and auditable record of non-receipt.

Your email request must include the subject line: “Missing Approval Documentation – [Your Full Name]”. In the body of the email, provide your full legal name (as registered), date of birth, approval date, transaction ID (if available), and a clear statement confirming that you have not received your approval documentation despite being notified of approval.

Please note that phone inquiries may help with immediate support; however, technical limitations such as disconnections, wait times, or human error may affect proper documentation. For urgent cases, you may contact support by phone and email, but only written communication ensures formal tracking and compliance.

Med Cards Now will acknowledge your email within 24 business hours and aim to resolve documentation issues within 72 business hours. You are advised to retain all communication records for reference. All notifications related to missing approval documentation must be submitted via email to ensure proper compliance and record-keeping.
